The Last Will and Testament of Benjamin Barlow

of the town of Lima in the county of Livingston and state of New York.


I Benjamin Barlow do make and publish this my last Will and Testament in manner and form following that is to say. First I give and bequeath unto my beloved wife Phebe Barlow all my household furniture of every kind and description and all debts and demands due, or to become due to me, whether by Bond, bill, note, account or otherwise howsoever and two cows, one called the red heifer and the other the brundle cow, ten sheep to be selected by her from the flock and one hog to be chosen by her from among my service; all my share of the grain in the Barn and also all my share and portion of the grain now growing as well upon my home farm as upon the farm known as the Robison farm - I also give and devise to my said wife the use of the east room on the first floor of my dwelling house with the Buttery adjoining and the East and West rooms in the chamber, and the use in common with my son Leicester of the cellar and Barn during her natural life. I also give to my said wife the one half of all the produce of my house farm and of the Robinson farm hereafter to be raised to be paid and delivered to her annually by my sons Leicester and Obed as hereafter mentioned during her natural life - she paying all my just debts and funeral expenses -

Item - I give and devise with my son Benjamin Barlow Jr his heirs and afsigns forever, forty-five acres of land from the southwest corner of the farm deeded by William Rice to my said son Benjamin and subsequently purchased by me at sheriff's sale being the same parcel of land now in pofsefsion of the said Benjamin Barlow Jr.

Item - I give and devise to my son Obed Barlow during the natural life of my said wife, the use and occupancy of my farm called the Robinson farm upon condition that he, the said Obed Barlow, shall till and cultivate the same in a propper and husband like manner, and pay and deliver to my said wife during her natural life the one half of all the annual produce of said farm - and after the decease of my said wife I give and devise to my said son Obed from the north side of the said Robinson farm now in pofsefsion of the said Obed - to hold the same to him his heirs and afsigns forever. -

Item - I give and devise to my son Leicester Barlow, the use and occupation of my home farm during the natural life of my said wife, upon condition that he the said Leicester shall till and cultivate the said farm in a proper and husband like manner, and pay and deliver to my said wife during her natural life the one half of the annual produce of said farm, and also furnish to her for the term aforesaid sufficient fuel prepared for the fire to supply at all times such parts of the said swelling house as I have herein before appropriate to her use - and after the death of my said wife, I give and devise to my said son Leicester Barlow in fee simple my said home farm except that part thereof lying West of the road leading by John Cutters known as the forty acre lot adjoining the town line on the West, lands of William Humphrey on the north and the said road on the East - and I further give and bequest unto my said son Leicester all the rest, residue and remainder of my personal estate, except the provision now laid up for the use of the family which I also give to my said wife

Item - I give and devise to my son Royal Barlow twenty five acres of land to be taken from the south side of the Robinson farm in fee simple from and after the death of my said wife -

Item - I give and devise to my daughter Phebe Barlow in fee simple from and after the death of my said wife, all the residue and remainder of my said Robinson farm -

Item - I give and devise to my daughter Lucy Blodgett in fee simple from and after the death of my said wife thirteen acres and one third from the south side of the forty acre lot parcel of my said house farm herein before described excepted out of the devise to my son Leicester -

Item - From and after the death of my said wife I give to my daughter Rhoda Way in fee simple thirteen acres and one third from the north side of the forty acre lot -

Item - All the rest residue and remainder of the said forty acre lot I give and devise to my grandchildren Sally Ann Bullard, James M Bullard, Mary Jane Bullard and William Bullard in fee simple from and after the death of my said wife to be equally divided between them when they shall respectively arrive at the age of twenty one years. -

Item - I give and bequeath to the four children of my deceased son Jon Barlow one dollar each to be paid by my Executrix when they shall respectively arrive at the age of twenty one years. And I further will and declare that in case my said sons Leicester and Obed, or either of them shall at any time after my decease and during the life of my said wife fail to perform the conditions herein exprefsed or either of them, on which the use and occupation of the said parcels of land were heretofore devised to them respectively during the life of my said wife, then and from thenceforth their several rights and interests in the said respective parcels for the term aforesaid shall cease and end and my said wife shall enjoy the sole use and occupation of their respective parcels anything herein contained to the contrary thereof notwithstanding - and I hereby appoint my said wife Executrix of this my last Will and Testament hereby revoking all former wills by me made.

Benjamin D Barlow of the town of Lima in the county of Livingston being duly sworn deposeth and said that he did subscribe the name of Benjamin Barlow at his request to the instrument now shown to him the deponent and which purports to be the last Will and Testament of the said Benjamin Barlow deceased bearing date the twenty sixth day of February in the year of our Lord one thousand eight hundred and thirty one - that he heard the said Benjamin Barlow deceased declare the same to be his last Will and Testament the he this deponent did subscribe his name as a witnefs thereto at the request of the said Benjamin Barlow deceased - and further that at the time thereof the said Benjamin Barlow was of sound mind and memory of full and not under restraint - and further the deponent saith not -
